Legal Marketing Blog Knowledge Base

Is it legal to post pictures from an official movie website onto a blog? I'm writing a story about the Dark Knight for a marketing agency's blog and need to find out if I can use pictures directly from the Dark Knight website. For my own site I wouldn't care, but they are worried about legal issues.
Marketing Revenue: Blog or Website? I have a great idea for a website that compiles information from other websites, media, and word of mouth. The information I research is public, so I'm pretty sure it is legal to copy it and paste into mine? I am not sure if i should start a blog, or website (with maybe a blog). The site will be rich in content and needed to be updated frequently and user interaction would be great! So a blog would sound like an ideal choice but my main focus here is TO MAKE MONEY through advertising such as Affiliate Marketing and Adsense. What would be the ideal choice here to maximize my profit? Also, can you explain how affiliate marketing works in detail? Or any other methods of revenue-generating marketing!!!! Thank You.
What is the best blogging platform for a podcast or a video blog? I'm an attorney in California and I've set up a new domain to market my practice. I want to make it a podcost or a video blog that will have short audtio and/or video clips short legal tips. I've been experimenting with imbedding video on my 360 page. I also have a blog on my regular law office website that is powered by Blogger.com. Blogger.com is okay, but I am looking for recommendations on the best blogging platform to do a podcast or video blog. I'm sure that I will need to host the video on a third party such as YouTube or Yahoo video, but I should have enough storage space and bandwidth to host the MP3 files on my own site. Any suggestions?
Affiliate marketing using blogger.com? Is it legal to blog about a product - say for instance "Nike Air Max" and have affiliate links to retailers sites or a product listing of "Nike Air Max" with all affiliate links in? Is this legal and would the company behind Nike have any problems with this if I was ranking on the first page for instance for "Nike Air Max"? I have been learning from various sources - more notably Patt Flynn. I will put a disclaimer in, thanks mate!

EARN EXTRA MONEY IN PAYPAL AS SEEN ON OPRAH AND 20/20 I did some research and found that PayPal does not allow pyramid schemes or chain letters. However, they do allow merchants to sell products online and collect the money. (A free host will work fine!) 3) Go into your paypal account, under merchant services, and follow the instructions to create a “buy it now” button. EARN EXTRA MONEY IN PAYPAL AS SEEN ON OPRAH AND 20/20 ______________________________________... Dear Friend, You probably have seen these, but they really really do work, give it a try -- think of how you waste $6 in a day, week or month. It's a minor investment with great rewards. This might really help you pay off those credit cards and give you the ability to move out. If you could start your own mail order list with an investment of $6.00, and make $800,000 over the next year would you do it? _____________________________________ ***Proven by various, highly-respected U.S. TV and Radio programs as being 100% legal, feasible and true.*** ***Oprah Winfrey and ABC's investigation team 20/20 also prove it can be done.*** IF A 15 YEAR OLD BOY COULD MAKE $71,000 IN JUST 5 WEEKS AND OTHERS $250,000 IN A FEW MORE WEEKS -- SO CAN YOU !!! Would you like to make $71,000 OR $250,000 in a few weeks? As seen on the Oprah Winfrey show and ABC's 20/20 ======================================... The true story that has everyone talking: Parents of a 15yr old boy find $71,000 in his closet: You may have seen this story featured on a number of major news programs (United States), and reported elsewhere around the world. His mother was doing some cleaning and putting some laundry away when she discovered a large brown paper bag that was suspiciously buried beneath some clothes and a skateboard in the back of her 15-year-old sons closet. Nothing could have prepared her for the shock she got when she opened the bag and found that it was full of dollar bills -- $71,000 to be precise!! "My first thought was that he had robbed a bank", says the 41-year-old woman, "There was over $71,000 in that bag, that's more than my husband earns in a year". The woman immediately called her husband at the car-dealership where he worked to tell him what she had discovered. He came home right away and together they drove to the boys school and picked him up. Little did they suspect that where the bills were coming from was going to be a bigger surprise than actually finding them in the closet. As it turns out, the boy had been sending out, via E-mail, a type of "Report" to other E-mail addresses that he obtained off the Internet. Everyday after school for the past 2 months, he had been doing this on his computer in his bedroom. "I just got an E-mail one day and I figured what the heck, I put my name on it like the instructions said and I started sending it out", says the 15-year-old. The E-mail letter he received had 5 names and addresses listed on it and contained instructions on how to send one $5 dollar bill to each person on the list. Then delete the name and address at the bottom of the list (Report # 5) and move the other 4 names and addresses down one step, finally adding your own name and address to the top of the list (Report # 1). The letter goes on to state that you would receive several thousand dollars in five-dollar bills within 2 weeks if you sent out the letter with your name and address at the top of the 5-address list. "I get junk E-mail all the time, and really did not think it was going to work", the boy continues. Within the first few days of sending out the E-mail, the Post Office Box that his parents had gotten him for his video-game magazine subscriptions began to fill up not with magazines, but envelopes containing $5 bills. "About a week later I rode my bike down to the post office and my Post Office Box had 1 magazine and about 300 envelopes stuffed in it." Over the next few weeks, the boy continued sending out the E-mail. "The five dollar bills just kept coming in and I just kept sorting them and stashing them in the closet, I barely had time for my homework". He had also been riding his bike to several of the banks in his area and exchanging the $5 bills for twenties, fifties and hundreds. "I didn't want the banks to get suspicious so I kept riding to different banks with like five thousand at a time in my backpack. I would usually tell the lady at the bank counter that my dad had sent me in to exchange the bills and he was outside waiting for me. One time t ... Well, you get the idea.
Is Using An Alias In Your Business Legal? Would you know if it's legal to use an alias in business? Here's an example Registered Business Name: Super Duper Weight Loss Registered Under : John Doe John doesn't want to reveal his real name to the public for privacy reasons so he decides to use an alias in his business named "Peter Patterson." "Peter Patterson" will be known to the public as the owner. So in the marketing (youtube videos) it will be John Doe playing as "Peter Patterson" giving away fantastic tips to promote Super Duper Weight Loss. The SDWL product itself will make a mention of Peter Patterson being the owner. The only way to find out the real owners name (John Doe) is by checking who registered the Super Duper Weight Loss business name. I live in Ontario and read from an American blog that using an alias is fine as long as you don't lie and mislead the audience. Is that true or is there more I should know? Thanks
Is it legal/ethical to use a recipe off the internet, market it, and refuse to give it out? Any information would be appreciated. As for the recipe, I don't know if it had a copyright or not. I didn't see one... The website itself looked like a mixture of about.com and a blog. I meant to market the product not the recipe...
What is your opinion on Immigration Reform being good for America’s security? Why do some groups push against bills that can make our country safer? Do they think Immigration Reform is only Amnesty? ==================================== For America’s Security The immigration system we have today makes little sense in terms of America’s security. With few legal options to come in through the system, many seek ways to go around it. The broken system has spawned a thriving market for smugglers and has generated chaos on the border. A seemingly random enforcement regime targets ordinary immigrant workers and families, diverting resources away from protecting against genuine threats. Millions of immigrants are unknown to the government. Unscrupulous employers have little fear of punishment for recruiting and exploiting undocumented workers and undermining their honest competitors. Immigration reform will allow more immigrants to come with a visa, not with a smuggler. It will require undocumented immigrants to get right with the law, register with the government, and go through government background security checks. This screening process will separate ordinary immigrants who have come seeking opportunities to better their lives from those who may be exploiting opportunities a broken system provides to those who may be coming to do us harm. Enforcement resources can then be trained on employers who flaunt labor laws and exploit undocumented immigrants, on smugglers who traffic in drugs and guns who are creating chaos on the border, and on violent individuals inside the country who may pose a threat to public safety. By getting ordinary immigrants in line for citizenship and prioritizing enforcement actions to target genuine threats, immigration reform will be good for America’s security. http://reformimmigrationforamerica.org/blog/why-reform/why-reform-for-americas-security/
NYT Article on Law Schools: No Longer Attractive? This article in the New York Times should be a real eye-opener for any students thinking about attending Law School: http://www.nytimes.com/2011/01/09/busine… Some excepts: "A generation of J.D.’s face[s] the grimmest job market in decades. Since 2008, some 15,000 attorney and legal-staff jobs at large firms have vanished, according to a Northwestern Law study. Associates have been laid off, partners nudged out the door and recruitment programs have been scaled back or eliminated....more entry-level legal work is now outsourced to contract temporary employees, both in the United States and in countries like India. It’s common to hear lawyers fret about the sort of tectonic shift that crushed the domestic steel industry decades ago." ""Avoid this overpriced sewer pit as if your life depended on it,” writes the anonymous author of the blog Third Tier Reality — a reference to the second-to-bottom tier of the U.S. News rankings — in a typically scatological review. “Unless, of course, you think that you will be better off with $110k-$190k in NON-DISCHARGEABLE debt for a degree that qualifies you to wait tables at the Battery Park Bar and Lounge.” “This idea of exceptionalism — I don’t know if it’s a thing with millennials, or what,” she says, referring to the generation now in its 20s. “Even if you tell them the bottom has fallen out of the legal market, they’re all convinced that none of the bad stuff will happen to them. It’s a serious, life-altering decision, going to law school, and you’re dealing with a lot of naïve students who have never had jobs, never paid real bills.” "“Most of us either went to the wrong law school, which is the bottom two-thirds, or we were too old when we graduated,” he said. “I was 32 when I graduated, and at 32 you’re washed up in this field, in terms of a shot at the real deal. They perceived me as somebody they can’t indoctrinate into slave labor and work to death for seven years and then release if they don’t like you.” So why is it so many students still want to go to law school?
What political ideology is this? I'm economically liberal, and socially libertarian. For example, federal taxes are necessary to support universal health care, infrastructure, educational institutions, and welfare for those unable to work (those unwilling to work don't get a penny) - since these sort of things become prohibitively expensive for many people, despite being necessary. But socially, I believe that the only criminal law that should exist is to protect the rights of a person, not society as a whole. For example, there should be no war on drugs (all are legal, if you abuse them it's your own damn fault), all sex/pornography laws (except rape, age of consent, child porn, etc) should be abolished ... basically, the state should not have to legislate anything unless one person is being victimized by another. I'd support libertarian parties, but they all want free market healthcare, abolishment of taxes, etc. which I don't agree with. And many liberal parties don't want to give individuals the civil liberties I believe they should be entitled to. I would also revoke the tax exempt status currently enjoyed by religious institutions. PS - I'm in Canada, and I think the party we have that's closest to these views is the Blog Quebecois, and they don't even run in my province (Alberta)
If America is so free and has a free market with free trade then why is its black market growing? This expanding black market in America demonstrates something important: The capacity of the market to exist without the state. Indeed, we libertarians who believe that a free society could thrive without a monopoly on violence (i.e., a state), should look upon the growing black market as overall a positive thing, and a model, for the most part, of civilized behavior. In a free market society, there would be no black market as such, at least not in anything that would be legitimate (there might still be small amounts of exchange in the realm of properly illegal activity, such as the hiring of hitmen). In a free society, contracts could be upheld for a large range of activity where there is no government protection, such as the street drug trade. But consider: Most of the illegal drug trade works and thrives. People get what they want out of it. Most illegal drug transactions are upheld and carried out honestly, with most economic actors walking away from the transactions satisfied. This all happens not just in the absence of government protection of contracts, but in the face of outright government hostility, prohibitions, policing, and threats of jail time. If a market can operate without the government protecting it, and indeed while the state is attempting at great cost to obstruct it, then we can safely argue that it would probably operate fine, and even better, without the state being involved at all. Not only would taking the state out of the picture allow for the now-illegal market to flourish without the cost of avoiding state sanction; getting rid of the state would allow for the advent of more market mechanisms, such as arbitration, openly publicized customer reviews leading to sophisticated public calculation of a business’s reputation, and contract enforcement. That one trillion dollars is moving around in the economy in direct confrontation with state intervention shows that the market is self-organizing. We do not need the state to oversee all this business— in fact, despite the state’s obstructive presence, the underground market thrives. Are there problems? Of course. There is fraud, which would be harder to get away with if this market were all out in the open, and not forced into the shadows by the state. There is misrepresentation and dishonesty. But these are the exceptions. And can we really believe there is less of this in the legal, regulated economy? http://www.independent.org/blog/index.php?p=4073
Why are Most National Christian Leaders endorsing huge new increases in permanent work permits for? Why are Most National Christian Leaders endorsing huge new increases in permanent work permits for foreign workers ? believe the last significant-sized churches not on the amnesty bandwagon are the Southern Baptists, Mormons and Church of Christ (not the United Church of Christ). Otherwise, all the country's substantial Mainline Protestant, Catholic and Evangelical denominations are endorsing huge new increases in permanent work permits for foreign workers. (Read my blog on the National Association of Evangelicals' latest dive into the pro-amnesty coalition.) I believe the federal "U-6 Unemployment Rate" shows the injustice the church leaders are promoting -- the injustice of a society that continues to crush the spirits of our society's most vulnerable under the boot of federal immigration policies that favor unscrupulous business interests. Accepted by progressives and conservatives alike as the best measure of suffering, the U-6 Unemployment Rate for everybody in the U.S. had risen to nearly 17% by mid-summer! It counts not only those actively looking for a job but discouraged workers who have recently given up looking as well as people involuntarily forced into part-time work. (All percentages in this blog are from the June 2009 Current Population Survey by the federal government. It appears that most rates have worsened since then.) DENOMINATIONAL LEADERS PREFER ILLEGAL ALIENS OVER IMMIGRANTS ALREADY HERE Even though the church leaders constantly talk about being kinder to the immigrants already living among us, their constant push for more and more new foreign workers to compete is harming the existing community which has a U-6 Unemployment Rate of 20%. Legal immigrants already here are likely the group that would benefit most from opening up the jobs currently held by illegal aliens. In the world of denominational leaders, nobody has higher priority than the illegal aliens, not even legal immigrants. And as much as the church leaders want more legal foreign workers this year, they will work next year for another wave of foreign workers that will make it exceedingly difficult for this year's crop to economically improve. CHURCH LEADERS PREFER FOREIGN WORKERS OVER U.S. HIGH SCHOOL GRADS (all ages) The U-6 Unemployment rate for U.S.-born high school graduates without college is 19%. These are the Americans who predominate in the construction, service and manufacturing jobs that are most sought by immigrant workers. Our current level of immigration is keeping millions of people out of jobs. But denominational leaders are lobbying Congress for immigration policies that will throw even more out of work -- -- and prolong how long they will stay jobless even when the recession is over. The people in this high school graduate category who are hurt most by church leaders' lobbying are (with unemployment rate in parentheses): •U.S.-born Hispanics (23%) •Black Americans (26%) CHURCH LEADERS PREFER FOREIGN WORKERS OVER YOUNG LESS-EDUCATED AMERICANS The effect of church leaders' high-immigration advocacy is even worse for young adults trying to enter the labor market. These are the people most likely to be starting families. Hurting them means especially being just plain mean to young struggling families. The U-6 Unemployment Rate for U.S.-born high school graduates who are between 18 and 29 is an incredible 30%. Almost one of every three young adults with a high school degree who wants to work CAN"T FIND A FULL-TIME JOB! But the church bishops and presidents and executive directors want millions more permanent work permits for citizens of other countries -- including illegal aliens. The inability to get a job, to hold a job or to earn a decent wage and benefits contributes heavily to low marriage rates, high rates of children without fathers in the home, to the joining of gangs and to other criminal and dependency pathologies during these formative years. But our national church leaders ignore the mounting hardship of our young, non-college adults, lobbying for more foreign workers to compete in their occupations. The people in this high school graduate category who are hurt most by church leaders' lobbying are: •U.S.-born Hispanics (33%) •Black Americans (37%) CHURCH LEADERS PREFER FOREIGN WORKERS OVER AMERICAN HIGH SCHOOL DROPOUTS College-educated Americans in general tend to take rather judgmental view of our fellow citizens who did not finish high school. But it is sad to see our national church leaders so willingly dismiss the needs of high-school dropouts. If we had not been importing low-skilled foreign workers the last 30 years, there would be plenty of jobs for hard-working high school drop-outs to live lives of modest dignity. The denominational immigration stances do not take into account in any way their effect on by far the most vulnerable in our national community. The U-6 Unemployment rate for U.S.-b
Have you seen this article? NFL has to bench Vick now By Terry Frei Denver Post Columnist Article Last Updated: 07/19/2007 10:06:43 AM MDT About Michael Vick ... Suspend the jerk. I tend to be a contrarian, and I tried not to join the bandwagon on this one. Among many other things, I was going to ask: Didn't the Duke lacrosse mess remind us that charges in a grand jury indictment aren't automatically true? In a market in which many of us justifiably excoriate Barry Bonds as a disgrace, yet many fans and (even more disgracefully) newspaper writers still portray Bill Romanowski as a charming rogue, can't we at least wonder about our adjustable standards? Those still are points to ponder. But the disturbing information in the federal grand jury indictment against the Atlanta Falcons quarterback and three others is overwhelming. Vick is Blogs Visit Terry Frei's new blog on All Things Colorado Sports. Visit All Things Avs to which Frei contributes. convincingly linked to the horrific dogfighting operation on his property in rural Virginia, mocking his "Who, me?" claims of innocence. This is not a dishonorable district attorney taking advantage of a malleable local grand jury. It stems from a careful federal proceeding, and the paucity of leaks was such that there were erroneous reports in recent days that Vick wouldn't be indicted. Under the NFL's heightened off-field conduct standards, commissioner Roger Goodell has been willing to judge in advance of the frequently glacial legal system, and that's another justification for him suspending Vick. He's done it before, and everyone understands that it's now as much a part of the NFL system as instant replay. Yes, I believe the worst. Vick is a scumbag. The Falcons even would be well-advised to suspend him before Goodell has to step in. On Wednesday, I called my brother, David, in New York to get his perspective. Why? He followed our father into the NFL, working as a public-relations executive with both the Broncos and the 49ers before moving into his own PR agency and the restaurant business. He also is the longtime television analyst on the Westminster Kennel Club and National dog shows, and he now is the full-time director of communications for the WKC. He and his wife, Cheri, walk their Brittany spaniels on the Upper East Side and are involved in programs utilizing dogs in hospital therapy work. "Michael Vick and people like him in all of this - and I guess we need to say 'allegedly' - are supposed to be great warriors," Dave said. "They should understand that having a dog fighting to the death is not what a warrior is all about, especially if they're the ones making it happen. The reality is people look up to these guys. "We're going to hear that it's the 'culture' and those kinds of things. Well, it's not a 'culture' to have a loyal, brave and courageous animal fight to the death so we can be entertained or gamble on it. That's not what entertainment, that's not what being a warrior is all about. It's sickening. "What about all these kids out there in those number 7 jerseys? You're going to tell them that it's OK? It's a proven fact that someone who's involved in animal abuse as a youngster, as they get older they're more prone to be involved in domestic abuse - or worse. They don't have any regard for living things. Those people who are involved are all cowards." In 2006, the WKC's "best in show" winner was a colored bull terrier, Rufus. The unfortunate offshoot of misuse and irresponsible breeding of bull terriers is that the "pit bull" label often is indiscriminately applied, even in local laws that ban specific breeds - as Denver does. Fact is, while the United Kennel Club registers an "American pit bull terrier," it's more of a contrived term than it is a specific breed, and the more predominant American Kennel Club doesn't follow suit. "Pit bulls" - the dogs used in fighting, or simply as an alleged confirmation of an owner's "toughness" - are mixed breeds, most often starting with a Staffordshire bull terrier as a base. "There are some cities in this country where Rufus can't go," Dave said. "But I've been all kinds of places with this dog and he loves everybody." Yet the bull terrier and the offshoots, Dave said, at first were "bred to be protectors. But because they're loyal and courageous and tough, if they fall into the wrong hands, people can redirect those personality traits and that temperament to be aggressive. It's too bad, because they can be the most loving, happy pets. But we're walking down the street in New York, and there are too many of them. People have them who shouldn't have them. If you need a macho dog to show you're macho, you're not. "Some of these guys seem to think they can get a dog like that and put a bunch of chains on it and walk down the street with it on a 10-foot leash, wreaking havoc, that's some recognition that they're tough guys." Suspending Vick in advance of the legal system's verdict might do little to chip away at that mentality, but it's the right thing for the NFL to do. Why do you think the countries with the most permissive Abortion laws actually have the lowest Abortion Rates? This is from the conservative newspaper The Wall Street Journal: "The World Health Organization and Guttmacher Institute said in a February study that overall abortion rates around the world are similar regardless of whether abortion is legal in a given jurisdiction. Countries with strict anti-abortion laws have developed black markets for abortion. The abortion rate — the number of abortions per 100 childbirths — is 29 in Africa, where abortion is illegal in most countries, and 28 in Europe, where abortion is generally permitted on broad grounds. The lowest rates in the world are in western and northern Europe, where abortion is accessible with few restrictions, the study said." Are Patents “Monopolies”? On occasion you get some defender of patents who is upset when we use the m-word to describe these artificial state-granted monopoly rights. For example here one Dale Halling, a patent attorney (surprise!) posts about “The Myth that Patents are a Monopoly” and writes, ” People who suggest a patent is a monopoly are not being intellectually honest and perpetuating a myth to advance a political agenda.” Well, let’s see. First, see my post Epstein and Patents, noting that the pro-patent Epstein writes: Patented goods are subject to a lawful monopoly created by the state in order to induce their creation. No one thinks that new pharmaceutical drugs will be invented by private firms that cannot receive a rate of return sufficient to recover [various costs]. … The legal monopoly granted by the patent is the only mechanism that allows the producer to recover those fixed costs…. Is the pro-patent Epstein being dishonest? And see my comments (1, 2) on The Three Stages of Invention post, excerpted below:First, as to whether patents are monopoly grants–hell, even the feds admit this: “Section 154 and related provisions [e.g. Sec. 271] obviously are intended to grant a patentee a monopoly only over the United States market….” U.S. Supreme Court, Deepsouth Packing Co. v. Laitram Corp., 406 U.S. 518 (1972). See also: King Instr. v. Perego, by the Court of Appeals for the Federal Circuit (“Congress made the policy choice that the “carrot” of an exclusive market for the patented goods would encourage patentees to commercialize the protected inventions so that the public would enjoy the benefits of the new technology during the patent term in exchange for granting a limited patent monopoly. In other words, the public expected benefits during “‘the embarrassment of an exclusive patent as Jefferson put it.’” Graham v. John Deere Co., 383 U.S. 1, 10-11 (1966).) See also Engel Ind. v. Lockformer Co. (“We hold that the disputed royalties provisions do not inappropriately extend the patent monopoly to unpatented parts of the patented system”); Carborundum Co. v. Molten Metal Eq. Co. (“A patentee, in demanding and receiving full compensation for the wrongful use of his invention in devices made and sold by a manufacturer adopts the sales as though made by himself, and therefore, necessarily licenses the use of the devices, and frees them from the monopoly of the patent.”) http://blog.mises.org/10272/are-patents-monopolies/ P:S: Well I always knew and believed that patents were part of a Monopoly scheme. So this cements it for me I am definitely an Austrian Economist.
What is your opinion on the economic boost through legalization (Amnesty)? and why haven't we legalized them yet? Legalization Would Boost Economy During Recession Legalization increases short-term incomes, job creating consumption and net tax revenues in the low wage segments of the labor market, as well as sets the long-term foundation for an expanding middle class and a more sustainable economic recovery. If Congress and President Obama legalized the current 10-12 million undocumented persons in the U.S. an economic stimulus of $30-36 billion in personal income, 750,000-900,000 new jobs, and $4.5 to $5.4 billion in net tax revenue would result! Movement now towards legalization and naturalization of the roughly twenty million legal permanent residents and undocumented persons would create local and state regional mini-booms in civic engagement. Legalization of the nation’s undocumented workers will provide a strong economic stimulus, and must be integrated as a necessary component of President Obama’s economic recovery strategy. Failure to do so would actually prove detrimental to faster and long lasting economic recovery. Legalization also has the virtue of combining moral and civil rights imperatives with society-wide economic benefits, strengthening the most vulnerable and exploitable low-wage segment of the labor market, and establishing the basis for both a more sustainable economic recovery. In other words, legalizing the current estimate of 10-12 million undocumented workers would result in a net income rise of $30-36 billion, support 750,000-900,000 new jobs, and generate $4.5 to $5.4 billion in net tax revenue! Is Security of our nation not important to the anti-immigration extremists? Immigration Reform would help with our security, but anti-immigration folks still want to push against it for some reason. Is this not important to them? http://reformimmigrationforamerica.org/blog/why-reform/why-reform-for-americas-security/ For America’s Security The immigration system we have today makes little sense in terms of America’s security.

The new Supreme Court ruling, the end of Democracy? Should the Supreme Court be abolished? http://blog.newsweek.com/blogs/thegaggle/archive/2010/01/22/the-sweeping-impact-of-scotus-campaign-spending-decision.aspx " * It adds to Republican chances of pickups in red states with small, cheap media markets. * It turns the cottage industry of campaign consulting into a Hollywood-lucrative major media sector. * It reduces candidates and political parties to mere appendages in their own campaigns. * It will turn corporate boardrooms into political cockfighting pits, since that is where the key decisions will be made. * It gives President Obama a populist issue, if he has the cojones and imagination and sense of injustice to take it on. * It rips the veil of "conservatism" from this court, which just rendered one of the most wildly "activist" opinions in decades. It makes a mockery of the legal theory of "original intent." The Founders would be rolling over in their graves." http://www.newsweek.com/id/232166?from=rss&utm_source=feedburner&utm_medium=feed&utm_campaign=Feed%3A+newsweek%2FTopNews+%28UPDATED+-+Newsweek+Top+Stories%29 "But this was no justification for the court's blockbuster, precedent-smashing Jan. 21 decision unleashing corporate executives to pour unlimited amounts of stockholders' money—without their consent—into ads supporting or attacking federal candidates. Indeed the 5–4 decision would allow any big company to spend a fortune attacking candidates whom many, or even most, of its stockholders would rather support. And corporations—including multinationals controlled by foreigners—will spend money on elections not to advance the political views of their stockholders, but to seek economic advantage." As if Scott "Hottie McAwesome" Brown wasn't bad enough, it seems as if the Right has found every way it could to suck this country dry of all its legitimacy left. The American people have no voice now, politics is officially run by the corporation from here on out. To CONSERVATIVE TSUNAMI: I believe in free-speech for individuals, not corporations. A corporation is not a person, and only has the interests of its own profit in mind. To u_r_a_libtard: Unions don't have NEARLY as much money as corporations. It's obvious who is the biggest beneficiary of this. Unions may have some money, but not nearly as much as the big guys.

Are any of you aware of what is going on and how your lives may soon be effected by Feb. 10, 2009? Please read this blog as well as visit http://www.worldmag.com/articles/14953 this website has another article that shows the potential threats to crafters, small business', charites, liability to resalers, E-bay sales, and on and on the list goes in some twisted reponse by our legislatures to response to toys with lead in them from China!!!! Consumer Products Safety Improvement Act of 2008 Earlier this week, news reports began circulating about the Consumer Products Safety Improvement Act of 2008 which would require third-party testing on consumer goods (including apparel) used by children. The purpose of the act is to keep lead-filled products away from children. It is directed at lead-based paint and phthalates (chemicals used to keep plastics pliable) in products that children might chew, suck on, or otherwise ingest. Beginning February 10, 2009 (the date the law goes into effect) clothing retailers and thrift stores will be throwing out children's clothing because they do not meet new federal regulations. This is the Consumer Product Safety Council web page that links to the actual legislation and their legal counsel's interpretation on how the law should be applied http://www.cpsc.gov/ABOUT/Cpsia/cpsia.HTML According to some reports, testing for lead and phthalates could cost as much as $30,000 per tested sample. We contacted the office of more than one U.S. Representative and were told that the law has been enacted, but the regulations have not yet been released. There is a chance the law would apply only to producers and importers, not retailers (including thrift stores). The law could also affect initial retailers, but not resellers. These are some of the details that are yet to be determined. Since we don't know exactly who will be affected by the new law, and to what extent the law will impact our ministries, here are some things that missions can do: Contact the Consumer Products Safety Commission at 800-638-2772. This is the agency that is writing the regulations. Ask them for a clarification on what types of outlets will be impacted by the regulations. Voice your concern as to how this will impact services for people in need. Call your member of Congress or Senator. Explain how their constituents might be impacted if the product testing is extended to thrift stores and free clothing distribution. Low income families who currently receive free donated clothing, or purchase them at a thrift store, will be forced to pay retail in a tough economic market. Social services to the poor will be reduced as income from clothing sales at the mission thrift store will decline, resulting in the inability to fund much needed assistance. It will cost jobs. Thrift stores provide employment to individuals; lower revenue means cutbacks. It will have a negative environmental impact as tons of serviceable clothing goes into landfills, rather than aiding needy families. The legislation dramatically impacts helping agencies (rescue missions, Salvation Army, Goodwill, Volunteers of America, churches and other community organizations with clothes closets) during a slow economy, when their assistance is most needed by the community. Ask your legislators for help in exempting missions and other non-profits that serve people in need. Write letters to the editor; include the amount of free clothing given to the community and the numbers of families served. Ask for support in seeing that the regulations not impact the most vulnerable members of the community (you may use many of the points from item #2 above). Voice your concern about lead and phthalates, but ask that the new legislation not place additional hardships on the youngest and poorest citizens. Remember that legislation can be changed and improved. Keep the lines of communication open with members of Congress and Senators for input into future laws of this sort. Don't panic, let the legislative process run its course, then be ready to respond when the full details are known. What does the following article mean ? Tech giants in human rights deal By Maggie Shiels Technology reporter, BBC News, Silicon Valley People using the internet in Beijing Google was accused of censoring 2% of search results in China Microsoft, Google and Yahoo have signed a global code of conduct promising to offer better protection for online free speech and against official intrusion. The Global Network Initiative follows criticism that companies were assisting governments in countries like China to censor the Internet. The guidelines seek to limit what data should be shared with authorities, in cases where free speech is an issue. "This is an important first step," said Mike Posner of Human Rights First. He told the BBC "What this is is a recognition by all these tech companies, the human rights groups and social investors that there has to be a collective response to this growing problem. "Companies need to step up to the plate and be more aggressive in challenging unwarranted government interference," he said. The initiative states that privacy is "a human right and guarantor of human dignity," and the agreement commits the companies to try to resist overly broad demands for restrictions on freedom of speech and the privacy of users. They will also assess the human rights climate in a country before concluding business deals and make sure their employees and partners follow suit. "These principles are not going to be a silver bullet, but the most important point for me is to provide transparency," said Danny O'Brien of the Electronic Frontier Foundation. "We have joined this initiative because we know that a wide range of groups working together can achieve much more than the company acting alone," said Andrew McLaughlin, Google's director of global public policy. 'Valuable roadmap' The impetus for such an agreement follows years of criticism that a number of businesses, including Google, Yahoo and Microsoft have complicity built what has been dubbed the "Great Firewall of China". Screen grab of Skype website Skype say they are abiding by Chinese laws over internet use Google has been accused of complying with Chinese government demands to filter internet searches to eliminate query results regarding topics such as democracy or Tiananmen Square. Microsoft has come under attack for blocking the blog of a prominent Chinese Media researcher who posted articles critical of a management purge at the Beijing News Daily. Canadian researchers uncovered that a Skype joint venture in China monitored users' communications. And a Chinese reporter Shi Tao was jailed for 10 years after Yahoo China provided his personal information to the Chinese government. Today Yahoo co-founder and CEO Jerry Yang welcomed the new code of conduct. "These principles provide a valuable roadmap for companies like Yahoo operating in markets where freedom of expression and privacy are unfairly restricted. Shi Tao, file picture Shi Tao's jailing sparked a controversy of Yahoo business practices in China "Yahoo was founded on the belief that promoting access to information can enrich people's lives and the principles we unveiled today reflect our determination that our actions match our values around the world," said Mr Yang. While China has been painted as the worst abuser, Colin Maclay of the Berkman Centre for Internet and Society at Harvard University said there are other countries and governments all over the world at fault. "The number of states actively seeking to censor online content and access personal information is growing. "And the means employed - technical, social, legal, political - are increasingly sophisticated, often placing internet and telecommunications companies in difficult positions." 'Business case' The Global Network Initiative was drawn up by the internet companies along with human rights groups, academics and investors. Adam Kanzer who is the managing director and general counsel at Domini Social Investments said as well as being the right thing to do, it also makes good business sense. He told BBC News "When you see the industry being caught up in the tactics of various regimes around the world, the business case is very clear. Freedom of expression and privacy is core to their business. "They depend on a wide open, freely accessible and secure internet. That's what they are about. If people don't trust the internet and believe they are secure, then that is counterproductive to their business." Computer keyboard, Eyewire The plan has yet to receive the support of internet companies in China The effort is already being seen by some as not going far enough. "After two years of effort, they have ended up with so little," said Morton Sklar executive director for the World Organisation for Human Rights USA. "It is very little more than a broad statement of support for a general principle without any concrete backup mechanism to ensure that the
Is it illegal to resell books I don't want on a blog? I've been saving up to buy myself a scooter to get around quicker. I got a job as a freelance writer, but it doesn't pay enough as I'm still new in the market. I've been proofreading horrible manuscripts and fanfictions, been writing pitches, etcetera, but I still haven't enough money. So I thought to myself while I was cleaning up this morning, "Maybe I should sell all the books I don't want." Hitting two birds with one stone, you could call it - I get rid of clutter at the same time as earning loads of money if I sell these books. Yeah, I did some calculating, and it all adds up to a little over seven grand. I read way too much. Soooo ... my question is, is it illegal to sell them on a blog? It says in the legal acknowledgments page - the one in which it says who first published the book and when, you know - that redistribution of one of the books I have without express permission of the publisher is prohibited. Nevertheless, I see a lot of people selling books on blogs ... so I thought there might be a loophole or something I could wiggle into. Help? Quizzard: I'm talking about the books I bought and no longer want. Trust me, the manuscripts I receive for editing - no one's gonna want those.
