is it legal for employers to use employees photographs for marketing?

- Depends on how the photo's are being used, terms of your contract etc. You will need to seek advice from an experienced source.
- When I was hired I had to sign an Employment Agreement. I believe it did have a clause about photographs. However, I doubt that every place has that. I don't think they can use your picture without permission.
- only with the employee's written consent.
- You have to give them WRITTEN permission, whether in a pre-employment contract, or one signed after. If it is stated in a document that you signed (such as a job description), that is still signed permission. However, if you have good cause and evidence that you were"duped" into signing, you still could have legal recourse.
- Yes, to limited use, as much as consented, in writing.
- in the stack of paperwork you signed when you were hired there was probally a photographic release. If you're the employer asking I would have them sign a release.
