is it legal for employers to use employees photographs for marketing?

  1. Depends on how the photo's are being used, terms of your contract etc. You will need to seek advice from an experienced source.
  2. When I was hired I had to sign an Employment Agreement. I believe it did have a clause about photographs. However, I doubt that every place has that. I don't think they can use your picture without permission.

  4. You have to give them WRITTEN permission, whether in a pre-employment contract, or one signed after. If it is stated in a document that you signed (such as a job description), that is still signed permission. However, if you have good cause and evidence that you were"duped" into signing, you still could have legal recourse.

  6. in the stack of paperwork you signed when you were hired there was probally a photographic release. If you're the employer asking I would have them sign a release.
