software legal question?

a customer agreement states: "ou may not compile or use the Properties or any other information obtained through the Services for the purpose of direct marketing, spamming, unsolicited contacting of sellers or customers, or other impermissible advertising, marketing or other activities, including, without limitation, any activities that violate anti-spamming laws and regulations." for a free pc program service. does that mean that i cant use the software to get information on items that i am selling? such as info on books by typing in isbn's. sorry the first word in quotation marks is "you" ok i want to use amazon web services to search info on books by typing in the isbn number and then use that information under the description of the book for sale on my website. my question is ; is that legal to use the information that i get on there to put under my books description? ie. publisher,publish date,subject, etc. so that i dont have to manually put that info in there.

This is really a question for http://www.groklaw.net I shall quote PJ's disclaimer IANAL -- I Am Not A Lawyer -- but again, in Off-topic section of any question they will most likely explain fair use to you, and if you pay careful attention you will find that content companies such as Viacom and the RIAA and some Software makers such as Microsoft are denying there is any fair use at all. In other words some of our biggest corporations have explicitly said they don't care what the law is. If you are spamming, direct marketing, or doing impermissable advertising you are not my friend, but as long as you are not using this software to get information about your customer base you are doing nothing wrong. IANAL though.
