Is there a legal process to using network marketing for your product?

I have seen more and more companies do this. I am wondering if there are legal procedures to go through? Also, how is everyone paid for their refferals or sales if they are not on the company payroll? Basically, how does this all work for the company and can any company use network marketing if it fits their product?

1. Network marketing only work if it doesn't interfere the pyramid pattern by paying someone for recruiting. BioPerformance is one fine example plus the products was a fraud.
