Is text marketing legal?

We have 5 cellular lines in our family plan and some mobile car wash company periodically sends us text messages. We do not have a text message plan so every time we receive a message. it costs us $.10 which is not a lot but it adds up. Plus it's the matter of principle; why do I even have to pay a single dime for some one else's business? Is there a legal action I can take against this guy? I tried calling AT&T and they said that I have to add a feature for $4.99/month so I can block certain numbers from sending me the text messages.

1. i dont know about the us legal system but i would change my service provider or contact a media/advertising attorney
2. Not sure if it is actually illegal, but certainly annoying. Just respond to these msgs with "STOP" and they should end.
